1. Acceptance of these Terms
These Terms of Service ("Terms") are an agreement between you and Ivoirelabs ("Ivoirelabs", "we", "us"), an independent game studio based in Abidjan, Côte d'Ivoire. They apply to our games, websites and related online services (together, the "Services"), including the mobile game HexRush Fusion.
By downloading, installing or playing one of our games, or by using ivoirelabs.com, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use online services without parental consent) to play our games. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms on your behalf.
3. License to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play our games on devices you own or control, for your own non-commercial entertainment. This license does not give you any ownership of the game, its content or any virtual items.
You may not, except where the law expressly allows it:
- copy, modify, distribute, sell or lease any part of the Services;
- reverse engineer, decompile or attempt to extract source code;
- use the Services to build a competing product or data set;
- access the Services through unofficial clients, bots or automation.
4. Accounts and sign-in
Our games use Firebase Authentication to create your player account. You can play with an anonymous account or link a supported sign-in provider (such as Google) to keep your progress across devices. You are responsible for the security of the devices and credentials you use to access your account.
You can delete your account and associated gameplay data at any time from the in-game settings, or by contacting our support team. Deletion is permanent and your progress, scores and virtual items cannot be restored.
5. Fair play and conduct
Our games are competitive and leaderboards only work if play is fair. You agree not to:
- cheat, exploit bugs, or use mods, scripts, memory editors or tampered clients;
- manipulate scores, attempts, energy, rewards or ad callbacks;
- interfere with or disrupt the Services or their servers;
- harass other players or use offensive display names;
- sell, buy or share accounts.
We use automated integrity checks on gameplay submissions. Violations may result in score invalidation, temporary suspension or permanent account bans, at our reasonable discretion.
6. Virtual items and energy
Games may include virtual items, currencies, energy or boosts ("Virtual Items"). Virtual Items have no monetary value, cannot be exchanged for real money or transferred between accounts, and may be modified or removed as part of game balancing. Any purchases are processed by the app store you used (Google Play or the App Store) under its own terms; refund requests must follow that store's refund policy.
7. Advertising
Our games are free to play and supported by advertising, including optional rewarded ads that grant in-game benefits. Ads are delivered by third-party networks described in our Privacy Policy. Attempting to forge or replay ad-reward callbacks is a breach of Section 5.
8. Leaderboards and display names
Your display name and scores may be shown to other players on leaderboards. Keep display names appropriate; we may rename or hide entries that are offensive, misleading or impersonate others.
9. Intellectual property
The Services — including game code, artwork, level designs, names, logos and sounds — are owned by Ivoirelabs or its licensors and are protected by copyright and other laws. "Ivoirelabs" and "HexRush Fusion" are trade names of Ivoirelabs. Nothing in these Terms transfers any intellectual property rights to you.
You may capture and share gameplay videos and screenshots for personal, non-commercial purposes (including monetized video platforms), provided you do not imply endorsement by Ivoirelabs.
10. Suspension and termination
We may suspend or terminate your access to the Services if you materially breach these Terms, if required by law, or if we discontinue a game. Where practical, we will show the reason for a suspension in-game. You may stop using the Services and delete your account at any time.
11. Disclaimers
The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free or available in every region, or that saved progress will never be lost.
12. Limitation of liability
To the maximum extent permitted by law, Ivoirelabs will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, progress or virtual items. Our total liability for all claims relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim or 50,000 XOF (approximately 75 EUR / 85 USD). Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence or willful misconduct.
13. Changes to the service or terms
Games evolve: we may add, change, rebalance or remove features, levels and Virtual Items. We may also update these Terms from time to time. For material changes we will give notice in-game or on this page and update the date above. Continuing to use the Services after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Côte d'Ivoire, without regard to conflict-of-law rules. Disputes will be submitted to the competent courts of Abidjan, Côte d'Ivoire, unless mandatory consumer-protection law in your country of residence provides otherwise.
